By booking a holiday with HyperFit Travel you confirm that you understand and agree with the following Terms & Conditions.
To book a holiday, a non-refundable booking fee of NZ$300 or AU$300 is required upon booking, or full payment. After a confirmation has been emailed to you OR an HyperFit Travel representative calls you to confirm your reservation, a courtesy hold requires payment within 24 hours to secure the reservation. Full payment (the balance) must be made within 60 days of the holiday start date. Prices are based per person, twin share (share with another guest or bring a friend/partner), or for private (single person) rooms where specified, but DO NOT include flights. Clients must have adequate travel insurance to cover all activities listed.
Please note, even if you have private health insurance in your respective Country of residence, it is unlikely that this insurance will cover overseas trips such as the retreats offered by HyperFit Travel. It is your responsibility to organise suitable travel and health insurance. Although we strongly encourage you to do so, you acknowledge that HyperFit Travel is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.
HyperFit Travel Cancellations Definitions
“Cancellation” is defined as not attending your scheduled holiday, including postponing or rescheduling. “You” refers to the guest booking an HyperFit Travel holiday. “We” refers to HyperFit Travel. It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of cancelling or postponing their holiday, but unexpected things do happen, so please consider purchasing travel cancellation insurance.
Travel Cancellation Insurance
Depending on the policy and conditions, travel cancellation insurance may pay for some or all cancellation fees. Strictly for informational purposes and not to be relied upon, with most agencies, this type of insurance should be purchased within 14 days of making your reservation to optimise your level of protection.
Guest Cancellation Policy
Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule (“the Cancellation fee schedule”):
If you cancel 60 days or more before your holiday start date, you will be refunded the full amount minus your deposit.
If you cancel less than 60 days before your holiday start date, you will forfeit your entire payment.
Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.
We do not offer credit for arriving late or leaving early.
HyperFit Travel Cancellation Policy
While we have never cancelled a holiday to date and will endeavour to maintain this record, if HyperFit Travel must cancel or change a scheduled holiday date for any reason whatsoever, you’re entitled to transfer your full retreat payment to another holiday date (either scheduled or at some future time). Alternatively you may request a refund of your applicable payment.
HyperFit Travel is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.
HyperFit Travel Holiday Details Change Policy
While we always aim to not change the details/elements of a package (such as accommodation, trainer, activities, catering/food, transport etc), HyperFit Travel reserves the right to change or substitute a detail/element for any reason.
Passports, Visas and Documents
It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with an HyperFit Travel package.
HyperFit Travel holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a package as compared with the advertised nature of the service.
You acknowledge that during a holiday you participate voluntarily in any and all activities arranged, and insofar as legally permissible, surrender your right to any cause of action against HyperFit Travel arising from any loss or damage to person or property that occurs during a holiday package.
Liability Waiver & Release
In consideration of the mutual promises exchanged herein, you agree as follows:
- Health Condition and Safety: Please recognise the fact that it is your responsibility to know your physical condition and any health problems before, during, and after seeking Trainer consultation /classes. As such, coaching from Trainer should not be followed without the prior approval of your physician. During your exercise program, every effort will be made to assure your safety. However, as with any exercise program, there are risks, including but not limited to increased heart stress and the chance of musculoskeletal injuries. In volunteering for this program, you agree to assume responsibility for these risks and waive any possibility for personal damage. You also agree that, to your knowledge, you have no limiting physical conditions or disability exists that would preclude an exercise program. By signing below, you accept full responsibility for your own health and well-being and acknowledges an understanding that no responsibility is assumed by the Trainer or HyperFit Travel.
- Stopping Exercises: You may refuse or stop any exercise for any reason. It is your responsibility to notify Trainer of any discomfort or pain arising from or during exercise, as well as, any and all other known physical limitations you have or experiences so that Trainer may accommodate you and substitute another exercise to work that particular muscle group.
Photo / Video Release Form
I hereby grant to HyperFit Travel the absolute and irrevocable right and unrestricted permission to use photographic portraits / images / videos in which I feature that are taken during the course of the holiday to use / republish / copyright, etc. for commercial use in association with HyperFit Travel’s business. For example; photos of you taken in the gym. I hereby release and discharge HyperFit Travel from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.
